Anthony's Petition: Congresswoman lets Anthony down

Charles Anthony Nealy (known as Anthony) is sitting on death row in Texas for a crime he didn't commit. This site aims to provide information regarding his case that proves he has been poorly represented and keep you up to date with his case.

All Anthony is asking for is a retrial so he can fairly put his side of the argument across - nothing more, nothing less.

Anthony was brave and dignified until the very end. He had his sister and brother in law, and his friends Ward and Doug to witness the execution.

On behalf of Anthony's friends and family, we would like to thank David Dow and his legal team for their incredible efforts to help Anthony. We would also like to thank all of the Reprieve team - all amazing people.

Anthony told us that sadly, his last chances were very much ruined by the incompetent and neglectful 'defense' provided by the lawyer John Nation. And that his final opportunities were scotched due to the vehemence that the local District Attorney, Kimberley Schaeffer pursued him with - wishing to see him dead and callouosly trying to blame Anthony's own family for attempting to tell the truth about police and prosecutorial harrassment of Memphis Nealy.

Anthony was a man of immense courage and fight. The information on this page and the story behind what happened to Anthony; the dirty tactics of the prosecution and the darkness lurking within those who are prepared to carry out the death penalty within Texas, if anything, demonstrate clearly that those like Anthony, who try and fight the system, can often be brought to death much more quickly.

Maybe some people feel that an act of revenge has taken place. But in reality it is just another senseless act of violence that has left yet another family and another group of friends, in mourning and loss.

Anthony is at peace and would want all who knew and loved him to be happy. This is what he said in his last words - that he didnt want us to be sad. He brought an awful lot of joy into our hearts and to our families. God bless him and God bless all of you who have helped to stand up to Darkness.

NEW EXECUTION DATE SET FOR ANTHONY

Unfortunately we have now heard that a new date has been set for Anthony's execution. It seems that the District Attorney whose job it is to see Anthony's execution through to the finish is intent on some kind of 'power trip'.

As friends of Anthony, we need to focus not on the politics of Texas and on the sad vendettas that those who like to exercise 'power' can pursue, but on supporting Anthony. By now you all know what works for Anthony, so please do your best to support him through your letters, postcards and books via Amazon - you will never know just how much your contact means to him! The background to the setting of the new date was that on February 7 2007, the Texas Court of Criminal Appeals denied Anthony's Prosecutorial Misconduct claim. The reason for the delay in learning this information is partly because that Court mistakenly notified Anthony's previous lawyer (John Nation), rather than his new lawyer.

*****UPDATE ON ANTHONY'S SITUATION******

Anthony spent Christmas in the Dallas County Jail - which houses some of the worst conditions in the USA. This is because he had his hearing in Dallas in earlier December. During this hearing it was agreed that because a key witness had come forward and recanted his testimony (that he had been coerced into making accusations against Anthony)- that a new decision should be made about this new situation before the 31st December.

This decision has not yet been made at the day of writing (31st December) and therefore, Anthony has been returned to his cell at Polunsky

In short, we are waiting to hear whether the presiding Judge over the 13th December hearing will either ask for more time to make a decision, rule that prosecutorial misconduct did indeed occur during Anthony's original trial, or rule that prosecutorial misconduct did not occur during Anthony's original trial.

Whichever ruling is made, it will go to the Texas Court of Criminal Appeals which will examine all of the information about Anthony's prosecutorial misconduct claim and then make a final decision.

We have no way of knowing how long all of this will take.

We urge you to continue to writing to Anthony at the Polunksy address mentioned on this page. But please be aware that Anthony is still on a lower disciplinary level because of his strong complaints over the fact that he was not allowed to receive a visit from his spiritual advisor on the original scheduled execution period - despite the fact that his spiritual advisor made all of the correct arrangements and had two non-refundable air tickets.

Anthony has NEVER been on anything other than the 'best behaviour' levels of discipline within the US prison system and we urge the texas Dept of Criminal Justice to show some sense and return Anthony's priveledges to him.

STOP PRESS!! EXECUTION STAYED FOR 16th NOV!!

Anthony has received a stay of execution from the Court of Criminal Appeals. This was because a key witness, Memphis Nealy came forward to state that they had been pressured and intimidated by a prosecutorial attorney during the initial trial. This attorney later resigned from the district attorney's office in July 2003, shortly after a defense attorney sought a new punishment trial for a Dallas man sentenced to death in another case, arguing that the attorney failed to correct testimony he knew was inaccurate.

Unfortunately the Judge involved in making this decision, declared some very prejudicial opinions against Anthony's case and her ability to preside objectively now over a further investigation has also been called completely into question.

The case has outraged international opinion in relation to the Texas system of 'injustice', with the Guardian national and international newspaper reporting on the case. See:

Supporters of Anthony noted that this website was used by the DA's office in order to 'play dirty' by assuming that members of Anthony's family were trying to influence the actions of a key witness. We can only say that we are pleased that your job in contributing to the murder of another person involved in this sad case was not such an easy one as it clearly is in Texas most days of the week....

Doug Tjapkes and his wife Marcia flew to Texas to visit Anthony on 14th November. They had arranged with Polunsky Unit to see Anthony before and during the (then) scheduled execution. However, when they arrived at Livingston, they were informed that they could no longer visit Anthony! This was truly outrageous!!! However, despite this callous treatment, Doug managed to speak on the local radio station - KDOL radio http://www.ontheradio.net/radiostations/kdolfm.aspx which has been set up as an outreach radio station for inmates.
